This Privacy Notice for Dickey Media LLC (doing business as Patchd) ("we," "us," or "our"), describes how and why we might access, collect, store, use, and/or share ("process") your personal information when you use our services ("Services"), including when you:

1. What Information Do We Collect?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

  • email addresses, from the waitlist, the free tools' export form, the beta application, the beta agreement acceptance, and accounts
  • names, from the beta application, and the name you type when you accept the Beta Test Agreement in the desktop app
  • usernames and passwords, for accounts (see Account Data below)
  • your answers on the beta application: your Discord handle, a profile link, your Windows version, what you mainly use audio software for, your microphone, your audio interface, what you listen on, whether you use ASIO, an optional note, and your confirmations that you are 18 or older, are in the United States, are not on a sanctions list, and will send reports
  • records of your acceptance of the Beta Test Agreement: your email address, the time, the agreement version, and whether you scrolled to the end and ticked the box, plus, in the desktop app, the name you typed and the app version
  • your email consent record when you create an account (see Account Data below)
  • diagnostic reports you choose to send from the desktop app
  • anything you write to us by email

Sensitive Information. We do not process sensitive information.

Payment Data. Nothing can be bought from us yet, so we collect no payment information: no card numbers, no security codes, and no billing addresses. When checkout opens, payments will be handled by Paddle. You may find their privacy notice here: https://www.paddle.com/legal/privacy.

Account Data. You can create a Patchd account on patchd.studio. An account uses your email address, a username, and a password. Our authentication provider, Supabase, stores the password in a scrambled form (a hash), not as you typed it. For each account we also keep your plan (Free or Studio) and a history of changes to it.

When you create an account (on the website, or in the desktop app from version 0.1.29, described below), you can tick a box to receive email from us. We store your choice, the time, the exact sentence next to the box, whether the box was shown to you ticked or unticked, and the country your IP address is in. The box starts ticked unless that country is in the European Union, the rest of the European Economic Area, the United Kingdom or its Crown Dependencies, Switzerland, Canada, or Australia, or we cannot tell your country; there it starts unticked. If you tick it, your address is added to our mailing list. If you later unsubscribe, that happens with our mailing list provider, Loops, and the choice stored with your account is not changed. The sign-up form does not ask your age.

Starting with version 0.1.29 of the desktop app, you can also sign in to your account from the app. Signing in creates a record for that computer: a device key, which the app keeps on your computer and of which we store only a scrambled form (a hash); a label with the app's name and version; the app version; the build channel (dev, beta, or public); when the record was created; when the app last checked in; when the sign-in expires; whether you signed out; and the IP address the app last checked in from. Signing out deletes the key from your computer and marks the record as signed out; we keep the record until you delete your account (see section 9).

We do not offer social media login and do not receive profile information from Facebook, X, or any other social platform. Beta invitations are decided automatically: when your answers on the beta application show that you are 18 or older, in the United States, not on a sanctions list, on Windows 10 or 11, willing to send reports, and have read the Beta Test Agreement, the invitation is sent without a person reviewing it. Beta testers are not required to create an account.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information, such as your Internet Protocol (IP) address and/or browser and device characteristics, is collected automatically when you visit our website and when the Patchd desktop app contacts our servers.

We automatically collect certain information when you visit, use, or navigate the Services. It may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, the country your IP address is in, information about how and when you use our Services, and other technical information. Some of it can identify you: the records we keep to limit how often our forms and sign-in can be used store IP addresses and email addresses as they were submitted, and when the desktop app is signed in to an account, we store the IP address it last checked in from with that account's device record. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

The information we collect includes:

  • Log and Usage Data. Our hosting provider, Vercel, records requests made to patchd.studio, by your browser or by the desktop app, in its logs: your IP address, your browser or app's identifying header (user agent), the address requested, the referring page, and the time. Some of our own server log lines also contain the email address or IP address involved in a beta application, a beta agreement acceptance, or a diagnostic report upload. Vercel keeps these logs for 30 days. On our website, Vercel Web Analytics and Speed Insights record which pages are viewed and how quickly they load. They recognize a visit by a scrambled code made from the request, which Vercel discards after 24 hours, and they do not tie what they record to your IP address.
  • Device Data. We collect device data such as information about the computer, phone, tablet, or other device you use to access the Services. It may include your IP address (or proxy server), browser type, and operating system. From the desktop app, it includes the app's version, your operating system, and your processor architecture (sent with every update check, described below) and, if you sign in, the device record described under Account Data above.
  • Approximate location, from your IP address only. Our hosting provider tells us which country your IP address is in. We use it in one place: when you create an account, it decides whether the email box starts ticked or unticked, and we store it with your consent record (see Account Data above). From version 0.1.29, the desktop app's sign-up screen asks our server for that choice each time it appears, and the server works it out from the country of the app's IP address without storing it. We do not use GPS, and we do not ask your browser or device for its location. The desktop app never reads your device's location, but the servers it contacts see its IP address, as every server does.

Information we receive from service providers

We receive a small amount of information about you from the service providers listed in section 4:

  • Resend, which delivers our account emails, tells us what happened to each email: the recipient's address, the subject, whether it was sent, delivered, bounced, or marked as spam, and when.
  • Vercel, our hosting provider, tells us the country your IP address is in, which we store when you create an account.
  • We have copied our contact list from our mailing list provider, Loops, into our own database: each contact's email address, how they signed up, whether they are subscribed, and when the contact was created.

Information collected by the Patchd desktop application

In Short: The Patchd desktop app contacts our servers on its own: to check for updates, to download updates and its voice models, in beta builds to record your acceptance of the Beta Test Agreement, and, from version 0.1.29, to load the account sign-up form and check your plan. It sends a diagnostic report only when you press the button. It reads the list of applications running on your computer, because that is how per-app audio routing works, and that list stays on your machine. From version 0.1.31, a diagnostic report you send also names the programs playing sound through Patchd's own playback devices.

Patchd is desktop software that runs locally. It contains no analytics library, no advertising identifiers, and no automatic crash reporting: crashes are written to its log on your computer and leave it only inside a diagnostic report you choose to send. Every request the app makes shows its IP address to the server that answers it. patchd.studio is hosted by Vercel, and dl.patchd.studio, where downloads come from, is served by Cloudflare.

What the app sends without you pressing anything.

  • Update check. Once per launch, about 4 seconds after the app has loaded (and not while the setup tour is on screen), the app asks patchd.studio whether a newer version exists. The request carries the app's version, your operating system, and your processor architecture, and no identifier. Our server stores nothing from it; Vercel's logs record it like any other request.
  • Update download. If a newer version exists and automatic updates are on (they are on by default, and you can turn them off in Settings > Updates), the app downloads the installer in the background from dl.patchd.studio. The download carries no identifier, and nothing is installed until you click.
  • Voice model list. On every launch, unless you removed the voices in Settings > Voices, the app fetches the list of voice model packs from dl.patchd.studio. It sends nothing but the request.
  • Voice models. On every launch, unless you removed the voices, the app downloads any voice model pack that is missing or out of date from dl.patchd.studio, without asking first. On first run that is every pack: the voice models and the program files (DLLs) that run them, more than 700 MB in total. You can also start this download from Settings > Voices. It sends nothing but the requests.
  • Beta Test Agreement acceptance (beta builds only). Right after you accept the agreement in the app, it sends us the name and email address you entered, the time you accepted, the agreement version and a fingerprint (hash) of its text, the app version, and whether you scrolled to the end and ticked the box. If it cannot reach us, it tries again on each launch until the record is stored. We store the record and email a copy of it to ourselves through our email provider, Loops. A decline is never sent.
  • Account sign-up form (from version 0.1.29). When you are not signed in, the app loads the account sign-up form from patchd.studio each time it shows the account screen, which is on every launch while you are signed out. Our server stores nothing from this request.
  • Plan check (from version 0.1.29). When you are signed in, about 8 seconds after every launch, and when you open Settings > Plan, the app sends its device key to patchd.studio to check your plan. Each check updates your device record with the time and the IP address of the check, so we hold, for each account and computer, when the app last checked in and from which IP address.

What the app sends when you ask it to. Checking for, downloading, and installing an update from Settings > Updates or the update pop-up (the same requests as above). Signing in, creating an account, and signing out (from version 0.1.29): signing in sends your email address and password, a label with the app's name and version, the app version, and the build channel; creating an account sends your email address, username, password, and your choice on the email box. Links such as the upgrade page and password reset open in your web browser, which makes its own request; the app sends nothing with them. And diagnostic reports, described next.

Diagnostic reports (beta builds only; you choose to send each one). In beta builds, if something goes wrong, you can send us a diagnostic report from the app's Settings or from the notice it shows when it detects a problem with your audio, or save a copy of it to a file on your computer instead. Public builds do not contain this feature at all. A report is never sent automatically. Before sending, the app offers a "Show me what is sent" view that displays the contents of the report so you can read it first. The report is built again when you press Send, so its log may have grown a little since you looked. A report contains:

  • The time it was made, the Patchd version, whether it is a debug or release build, and your operating system and processor architecture
  • Any note you choose to type describing the problem. This is optional, up to 500 characters, and you write it yourself
  • The record of your first-time setup: how it ended, the build channel, the step it ended on, how many times each step was shown, when it started and ended, and how many times it has run, so we can find where setup breaks
  • The names of the sections in the app's settings file, its format version, when your mixer setup was last saved, how large that save is, and when it was moved from the app's older storage. The settings file itself is not included
  • The voice model packs installed, and their versions
  • The application and audio engine log files for the current run and the previous run, which record what the software did and any errors it hit. From version 0.1.29 the log also records your mixer settings each time they change (which inputs are routed to which outputs and buses, volumes, mute, solo, mono, timing offsets and which Persona voice is on, never a name you typed), counts of how well the audio engine is keeping up, how often audio clipped or engaged the limiter, how many other programs are recording from each Patchd bus (only the number, never which programs), the format of each audio device, your Windows version and build, and the version of the Patchd audio driver. From version 0.1.31 (not yet released on the date above), the log also records which programs are playing sound through Patchd's own playback devices (Patchd Desktop, Patchd Communications and the Patchd Cable devices), by the name of each program's file, for example Discord.exe or chrome.exe, so we can see what was sending sound through Patchd when a problem happened. These entries give only each program's file name, never where the program is on your disk or anything else about it, and a new one is written only when what is playing changes. Programs recording from a Patchd bus are still only counted, never named

The upload also shows us your IP address and the standard headers that the app's built-in browser component (Microsoft WebView2) adds, including its user agent.

The log files deliberately keep the names of your audio devices (for example "Scarlett 2i2" or "Sam's Headset"). Device names are frequently the entire answer to an audio problem, so removing them would usually make the report useless. Please be aware that a device name you have personalized may contain your own name. The logs also contain the folder paths of the app's own log and settings folders, and, if a program Patchd had seen playing audio has since been deleted, that program's location on your disk.

Before the report leaves your computer, the app removes your Windows account name and your computer name from it. This removal is done on your machine, before transmission. We describe it as removal on a best effort basis rather than as a guarantee: it is automated text processing, and we would rather state its limits than overstate its reliability. Precisely, it replaces three things: the path of your Windows user folder, your Windows account name, and your computer name, the last two only when they are at least 3 characters long. Everything else stays as it is, including email addresses, other people's names, and folder paths on other drives.

Diagnostic reports are stored privately with our hosting provider, Vercel, in the United States, and are not publicly accessible. The people we authorize can list and download them through a page protected by a secret key. They are used only to diagnose problems with the software.

The list of applications running on your computer. Patchd lets you route individual applications to their own audio channel. To offer you that choice it has to know which applications are currently producing audio, so it reads the list of running applications, including each one's name, its location on your disk, and its icon. This happens while Patchd is running.

This list is not transmitted to us. It stays on your computer, and a copy of your per-application routing choices is saved locally so your setup survives a restart. The list itself is not included in diagnostic reports and we never receive it. There are two exceptions, both described above, and both reach us only in the log of a diagnostic report you choose to send: when a program Patchd had seen is deleted, the log notes that program's location on your disk; and, from version 0.1.31, the log names each program playing sound through Patchd's own playback devices, by its file name only.

What Patchd stores on your computer. Your settings and mixer setup (devices, labels, routing, levels, effects and voices), the record of your first-time setup, the list of VST plugins it found with their locations, the dismissed update notices and your automatic update choice, and, in beta builds, your Beta Test Agreement acceptance, including the name and email address you entered. The per-application list: every program Patchd has seen play audio, with its name, location on disk, icon, any name you gave it, and when it was last seen, plus your routing choices. Its log files, the window size and position, and the voice models with the program files that run them. From version 0.1.29, when you sign in: your device key, email address, username, and plan, and when they were last checked.

Uninstalling removes the app. It deletes your settings, logs, and sign-in only if you tick "Delete app data", which starts unticked. It never deletes the voice models or the per-application list, which stay in the Patchd folder in your local application data.

Patchd does not record, store, or transmit your audio. Microphone and system audio are processed live on your computer and are never written to disk or sent anywhere by Patchd.

Videos on our website

Some pages show a YouTube video. The video player is not loaded until you click the video's picture, which we serve ourselves. When you click, your browser connects to YouTube (youtube-nocookie.com), a Google service, which receives your IP address, your browser's details, our website's address (not the page you are on) and the video you play, and may store data in your browser inside the player. Google's handling of that data is described in its privacy policy. We do not use any Google API.

2. How Do We Process Your Information?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We process the personal information for the following purposes listed below. We may also process your information for other purposes only with your prior explicit consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, on the website and from the desktop app, as well as keep your account in working order.
  • To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service.
  • To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service.
  • To send administrative information to you. We may process your information to send you details about our products and services, changes to our terms and policies, and other similar information.
  • To fulfill and manage your orders, once checkout opens. Nothing can be bought from us yet. When it can, we may process your information to fulfill and manage your orders, payments, returns, and exchanges made through the Services, with payments handled by Paddle.
  • To request feedback. We may process your information when necessary to request feedback and to contact you about your use of our Services.
  • To send you marketing and promotional communications. We may process the personal information you send to us for our marketing purposes. Your email address is added to our mailing list when you join the waitlist, enter it to export from one of our free tools, apply for the beta, or create an account with the email box ticked. Accepting the Beta Test Agreement on our website adds it to our beta testers' list. You can opt out of our marketing emails at any time. For more information, see " What are your privacy rights?" below.
  • To protect our Services. We may process your information as part of our efforts to keep our Services safe and secure, including fraud monitoring and prevention.
  • To identify usage trends. We may process information about how you use our website, through Vercel Web Analytics and Speed Insights, to better understand how it is being used so we can improve it. The desktop app contains no analytics.
  • To save or protect an individual's vital interest. We may process your information when necessary to save or protect an individual's vital interest, such as to prevent harm.
  • To send service-related notifications. We may process your information to tell you about outages, product updates, and changes that affect your setup.
  • To manage your plan and your signed-in devices. We use your account and the device records described in section 1 to tell the desktop app which plan your account has, to keep each computer signed in, and to let you sign a computer out. Nothing can be bought yet, so no payment information is involved.
  • To provide AI-powered features, once Patchy is released. Patchy, the AI assistant planned for the Patchd mixer, is not built yet. When it is released, we will process the requests you send it, your audio routing setup, and related contextual information through a third-party AI service in order to deliver it. It is designed to help you configure audio routing, recommend filter settings, and guide you through using the software. See section 6.
  • To ensure software compatibility and stability. We use the version, operating system, and processor architecture that the desktop app sends with each update check, and the diagnostic reports you choose to send (which include audio device names and log files), to diagnose technical issues, identify compatibility problems with specific hardware or software combinations, and improve the reliability of Patchd across the wide range of audio setups our users have.

3. What Legal Bases Do We Rely On to Process Your Information?

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e., legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfill our contractual obligations, to protect your rights, or to fulfill our legitimate business interests.

If you are located in the EU or UK, this section applies to you.

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases to process your personal information:

  • Consent. We may process your information if you have given us permission (i.e., consent) to use your personal information for a specific purpose. You can withdraw your consent at any time. Learn more about withdrawing your consent.
  • Performance of a Contract. We may process your personal information when we believe it is necessary to fulfill our contractual obligations to you, including providing our Services or at your request prior to entering into a contract with you.
  • Legitimate Interests. We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. For example, we may process your personal information for some of the purposes described in order to:
    • Send users information about special offers and discounts on our products and services
    • Analyze how our Services are used so we can improve them to engage and retain users
    • Diagnose problems and/or prevent fraudulent activities
    • Understand how our users use our products and services so we can improve user experience
    • Once paid plans are on sale, to protect our revenue and intellectual property by ensuring that purchased software licenses are used only by the customers who paid for them, and to prevent piracy, unauthorized distribution, and license abuse that would harm our business and our paying customers. Nothing is on sale yet.
    • To deliver core product functionality that users rely on (and, once paid plans are on sale, have purchased), and, once Patchy is released, to provide an enhanced user experience that differentiates Patchd from competing audio routing software through intelligent automation and assistance.
    • To maintain a high-quality, reliable product that works correctly across diverse user environments. Audio routing software interacts with complex hardware and software ecosystems, and understanding how Patchd performs on real-world configurations is essential to fixing bugs, preventing crashes, and delivering the stable experience users expect.
  • Legal Obligations. We may process your information where we believe it is necessary for compliance with our legal obligations, such as to cooperate with a law enforcement body or regulatory agency, exercise or defend our legal rights, or disclose your information as evidence in litigation in which we are involved.
  • Vital Interests. We may process your information where we believe it is necessary to protect your vital interests or the vital interests of a third party, such as situations involving potential threats to the safety of any person.

If you are located in Canada, this section applies to you.

We may process your information if you have given us specific permission (i.e., express consent) to use your personal information for a specific purpose, or in situations where your permission can be inferred (i.e., implied consent). You can withdraw your consent at any time.

In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent, including, for example:

  • If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way
  • For investigations and fraud detection and prevention
  • For business transactions provided certain conditions are met
  • If it is contained in a witness statement and the collection is necessary to assess, process, or settle an insurance claim
  • For identifying injured, ill, or deceased persons and communicating with next of kin
  • If we have reasonable grounds to believe an individual has been, is, or may be victim of financial abuse
  • If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province
  • If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records
  • If it was produced by an individual in the course of their employment, business, or profession and the collection is consistent with the purposes for which the information was produced
  • If the collection is solely for journalistic, artistic, or literary purposes
  • If the information is publicly available and is specified by the regulations
  • We may disclose de-identified information for approved research or statistics projects, subject to ethics oversight and confidentiality commitments

4. When and With Whom Do We Share Your Personal Information?

In Short: We may share information in specific situations described in this section and/or with the following categories of third parties.

Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents ("third parties") who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our third parties, which are designed to help safeguard your personal information. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will also not share your personal information with any organization apart from us. They also commit to protect the data they hold on our behalf. How long each of them keeps it is described in section 9.

The third parties we share personal information with, what they do for us, and what they receive, are as follows:

  • Vercel (website hosting, cloud computing, data storage, and website analytics). Hosts patchd.studio, which the desktop app also contacts, so it receives the IP address and request details of every visit and of every request the app makes to patchd.studio. It stores diagnostic reports, beta applications, and Beta Test Agreement acceptance records (Vercel Blob, in the United States), and runs Vercel Web Analytics and Speed Insights on our website.
  • Supabase (account registration and authentication, and our database). Holds accounts (email address, username, password in scrambled form), plans and their history, device records, email consent records, the list of email sign-ups, the records we keep to limit how often our forms can be used (IP addresses and email addresses), and email delivery events.
  • Loops (mailing lists and email). Holds your email address, the lists you are on, how you signed up, and whether you are a beta applicant or tester. It sends our emails to those lists and our beta invitation emails, which include your first name, and it carries copies of beta applications and in-app Beta Test Agreement acceptances to us by email.
  • Resend (email delivery). Delivers our account emails, such as sign-up confirmations and password resets, so it receives your email address and the email, and it reports back to us whether each one was delivered. Resend keeps a record of each email for 30 days.
  • Google (Google Workspace, email). Hosts our @patchd.studio mailboxes, so it receives every email sent to our addresses: the emails you send us, including privacy requests, and the copies of each beta application and each in-app Beta Test Agreement acceptance that Loops delivers to us. An email stays in our mailboxes until we delete it, and a deleted email can be recovered for up to 55 days.
  • Cloudflare (downloads). Serves dl.patchd.studio, where installers, updates, and voice models are downloaded from, so it receives the IP address and request details of each download.
  • Termly (privacy requests). Hosts our data subject access request form, so it receives whatever you enter into it.
  • Paddle (payments). When checkout opens, Paddle will process payments. Nothing is shared with Paddle today.
  • Anthropic (AI). When Patchy is released, the requests you send it, your audio routing setup, and related contextual information will be sent through our server to Anthropic, whose Claude model answers them (see section 6). Patchy is not built, and nothing is sent to Anthropic for it today.

Separately, when you click a video on our website, your browser connects to Google's YouTube directly, as described in " Videos on our website" in section 1. Google handles that data under its own privacy policy.

We also may need to share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

5. Do We Use Cookies and Other Tracking Technologies?

In Short: We may use cookies and other tracking technologies to collect and store your information.

Our website's own code sets a small number of cookies and one browser storage item, each listed in our Cookie Notice: one keeps you signed in to your account, one lets you download the beta installer after you accept the Beta Test Agreement, one keeps the people who run the beta signed in to its pages, and one remembers that you unlocked a free tool's export. Our website analytics, Vercel Web Analytics and Speed Insights, sends measurements of the pages you view and how quickly they load from your browser to Vercel. Our website contains no tracking pixels.

We do not use advertising cookies or any other advertising technology on our website. The only storage set from another company's website is YouTube's, which it may set inside its video player after you click a video.

To the extent these online tracking technologies are deemed to be a "sale"/"sharing" (which includes targeted advertising, as defined under the applicable laws) under applicable US state laws, you can opt out of these online tracking technologies by submitting a request as described below under section "Do United States residents have specific privacy rights?"

6. Do We Offer Artificial Intelligence-Based Products?

In Short: We offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies.

Patchy, the AI assistant planned for the Patchd mixer, is not built yet and is not present in the software you can install today. This section describes how it will work when we release it, so that the terms are published before the feature exists rather than after. Nothing in the current application sends your requests, your routing setup, or any other information to an AI service.

Separately, and worth stating because the word "AI" is used for both: Patchd's AI voices in Persona run entirely on your own computer. Converting your voice happens locally on your machine. Your audio is not uploaded, not sent to any service, and not used to train anything.

When released, Patchy will offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies (collectively, "AI Products"). These tools are designed to enhance your experience and provide you with innovative solutions. The terms in this Privacy Notice will govern your use of the AI Products within our Services.

Use of AI Technologies

When Patchy is released, we will provide the AI Products through a third-party service provider (the "AI Service Provider"): Anthropic, whose Claude model will answer your requests. The desktop app will send your requests to our server, and our server will send them to Anthropic. As outlined in this Privacy Notice, your input, output, and personal information will be shared with and processed by the AI Service Provider to enable your use of our AI Products for purposes outlined in "What legal bases do we rely on to process your personal information?" You must not use the AI Products in any way that violates the terms or policies of the AI Service Provider.

Our AI Products

Our AI Products are being designed for the following functions:

  • AI insights
  • Text analysis
  • Personal Recommendations
  • Automated setup assistance
  • Configuration generation

How We Process Your Data Using AI

When Patchy is released, all personal information processed using our AI Products will be handled in line with our Privacy Notice and our agreement with the AI Service Provider. This is intended to ensure high security and safeguard your personal information throughout the process.

How to Opt Out

We believe in giving you the power to decide how your data is used. To opt out, you can:

  • Users can opt out of AI-based processing by not using Patchy. Patchy will be an optional feature, sold separately, that requires explicit user activation. Users who do not use Patchy will not have their data processed by AI platforms through it.

7. How Do We Handle Your Social Logins?

In Short: We do not offer social media login and receive no information from social platforms about you.

We do not offer social media login. There is no "sign in with Facebook" or "sign in with X" option in Patchd or on patchd.studio, and we do not receive your name, email address, friends list, profile picture, or any other profile information from a social platform.

Accounts use an email address, a username, and a password, as described under "Account Data" in section 1.

8. Is Your Information Transferred Internationally?

In Short: We may transfer, store, and process your information in countries other than your own.

Our database (Supabase), our website's server functions (Vercel), which also answer the desktop app, and our file storage (Vercel Blob) are in the United States. Cloudflare serves downloads from locations around the world. Regardless of your location, please be aware that your information may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your personal information (see " When and with whom do we share your personal information?" above), in the United States and other countries.

If you are a resident in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, then these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. However, we will take all necessary measures to protect your personal information in accordance with this Privacy Notice and applicable law.

European Commission's Standard Contractual Clauses:

We have implemented measures to protect your personal information, including by using the European Commission's Standard Contractual Clauses for transfers of personal information between our group companies and between us and our third-party providers. These clauses require all recipients to protect all personal information that they process originating from the EEA or UK in accordance with European data protection laws and regulations. Our Standard Contractual Clauses can be provided upon request. We have implemented similar appropriate safeguards with our third-party service providers and partners and further details can be provided upon request.

9. How Long Do We Keep Your Information?

In Short: We keep your account until you delete it, we delete what we collect for the beta when the beta ends, and we delete diagnostic reports after 90 days. Our service providers keep some copies for set periods, listed at the end of this section.

We keep your personal information for the periods in this section, unless the law requires us to keep it longer (for example, for tax or accounting). We delete it sooner if you ask us to (see section 18), or if a problem comes up that calls for it.

Your account: until you delete it

We keep your account, its email consent record, its plan and the history of changes to the plan, and the records of computers signed in to it (including computers that have signed out, with the IP address each last checked in from) until you delete the account. You can delete it yourself on patchd.studio (see "Account Information" in section 12). Deleting it removes all of that straight away, and with it every entry for your email address in our list of email sign-ups and in our email delivery events, the records with your email address that limit how often our forms can be used, and your contact in Loops, our mailing list provider.

Beta records: until the beta ends

We keep the following until the beta ends, and then delete them:

  • beta applications
  • Beta Test Agreement acceptance records
  • the copies of beta applications and in-app Beta Test Agreement acceptances that Loops delivers to our mailboxes
  • email delivery events

A beta application or an acceptance record is not part of an account, so deleting your account does not delete it. Ask us if you want it deleted sooner.

Our mailing list: until you ask us to delete your address

We keep our list of email sign-ups (from the waitlist, the free tools, beta applications, beta agreement acceptances on our website, and accounts created with the email box ticked) and the contacts on our mailing lists in Loops while we run the mailing list. If you unsubscribe, Loops keeps your address marked as unsubscribed until it is deleted. We delete it when you ask us to, or when you delete your account.

Diagnostic reports: 90 days

Diagnostic reports sent from the Patchd desktop application are deleted automatically 90 days after they are received. This is performed by a scheduled job that runs daily and removes every report past that age; it is not a manual process and does not depend on anyone remembering to do it.

You do not have to wait for that. If you want a report you sent removed sooner, email privacy@patchd.studio with the reference code the app gave you when you sent it, and we will delete it.

Records that limit how often our forms can be used

To stop abuse, we keep records of the IP addresses and email addresses used on our forms, sign-in, and the servers the desktop app contacts. Records older than 24 hours are removed from time to time as new requests arrive. Nothing removes them on a schedule, so when traffic is low they can stay much longer.

Copies our service providers keep

Our service providers keep some information on schedules they set, so a copy of something we delete can stay with them for a while:

  • Vercel keeps its request logs, including the lines our own server writes, for 30 days.
  • Supabase keeps its logs, and any backups of our database, for up to 7 days.
  • Resend keeps a record of each email it delivers for 30 days.
  • Google Workspace lets a deleted email be recovered for up to 55 days.
  • Vercel Web Analytics keeps page view statistics, which do not identify you, for at least 12 months, and may keep them longer.
  • Loops, Cloudflare, Termly, and Vercel Speed Insights keep what they receive for periods set by their own policies.

10. How Do We Keep Your Information Safe?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

11. Do We Collect Information From Minors?

In Short: We do not knowingly collect data from or market to children under 18 years of age or the equivalent age as specified by law in your jurisdiction.

We do not knowingly collect, solicit data from, or market to children under 18 years of age or the equivalent age as specified by law in your jurisdiction, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or the equivalent age as specified by law in your jurisdiction or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age or the equivalent age as specified by law in your jurisdiction has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 18 or the equivalent age as specified by law in your jurisdiction, please contact us at privacy@patchd.studio.

12. What Are Your Privacy Rights?

In Short: Depending on your state of residence in the US or in some regions, such as the European Economic Area (EEA), United Kingdom (UK), Switzerland, and Canada, you have rights that allow you greater access to and control over your personal information. You may ask us to review, change, or delete your account at any time, depending on your country, province, or state of residence.

In some regions (like the EEA, UK, Switzerland, and Canada), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; (iv) if applicable, to data portability; and (v) not to be subject to automated decision-making. If a decision that produces legal or similarly significant effects is made solely by automated means, we will inform you, explain the main factors, and offer a simple way to request human review. In certain circumstances, you may also have the right to object to the processing of your personal information. You can make such a request by contacting us by using the contact details provided in the section "How can you contact us about this notice?" below.

We will consider and act upon any request in accordance with applicable data protection laws.

If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your Member State data protection authority or UK data protection authority.

If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section "How can you contact us about this notice?" below.

However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, or by contacting us using the details provided in the section "How can you contact us about this notice?" below. We will then stop sending you marketing emails, and Loops keeps your address marked as unsubscribed until it is deleted (see section 9). However, we may still communicate with you, for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

Account Information

You can delete your account yourself, at any time, on patchd.studio: sign in, open your account page, and choose Delete account. You confirm with your password. From version 0.1.29, the desktop app's Settings > Plan links to that page. Section 9 says what deleting your account removes and what is kept. If you would like to review or change the information in your account, or have us delete it for you, you can:

Neither our website nor the desktop app lets you change your email address or username yourself; we make those changes by hand when you ask.

Upon your request to terminate your account, we will delete your account and its information as described in section 9. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. 13. Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

14. Do United States Residents Have Specific Privacy Rights?

Will your information be shared with anyone else?

We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. Learn more about how we disclose personal information to in the section, "When and with whom do we share your personal information?"

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be "selling" of your personal information.

We have not sold or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. How to Exercise Your Rights

To exercise these rights, you can contact us by submitting a data subject access request (a form hosted for us by Termly), by emailing us at privacy@patchd.studio, or by referring to the contact details at the bottom of this document.

Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable laws.

Request Verification

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. We will only use personal information provided in your request to verify your identity or authority to make the request. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes.

If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request and the agent will need to provide a written and signed permission from you to submit such request on your behalf.

Appeals

Under certain US state data protection laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at privacy@patchd.studio. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may submit a complaint to your state attorney general.

California "Shine The Light" Law

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us by using the contact details provided in the section "How can you contact us about this notice?"

We collect and process your personal information under the obligations and conditions set by Australia's Privacy Act 1988 (Privacy Act).
